The judges on the motions panel were Canby (a Carter appointee), Smith (G.W. Bush), and Forrest (Trump)

Judge Forrest concurred, saying that the administration hadn't shown a need for emergency relief. And, while expressly declining to comment on the merits, notes that "the exception to birthright citizenship urged by the Government has never been recognized by the judiciary."

The case will be assigned to a different panel of judges for the merits. So, this panel's ruling isn't the final word.

However, it suggests the administration is going to face an uphill battle on appeal.

Trump appointed 10 of the judges on this court, and GW Bush appointed 9 (counting those in senior status). My guess is they won’t ask for en banc review of the denial of the emergency stay, but they’ll absolutely ask for it if the merits panel rules against them.
