A lawyer for the federal government and an appeals judge got into a heated exchange when the lawyer could not answer whether detained Tufts University student Rumeysa Öztürk's free speech is protected.

The lawyer, Ensign, “would” not answer whether Ozturk’s free speech is protected. He certainly “could” answer. It’s not just settled law, it’s basically comatose law - no one is going to rouse it and turn it over because arguing the alternative in this context is so outrageously dumb.
Judge asks if Ozturk's free speech is protected & the government lawyer says, "Your honor, we haven't taken a position on that." Judge responds,"Take a position."
He responds, "I don't have the authority to make those decisions." Apparently government lawyers need to brush up on the Constitution.
Justice Scalia, one of the most conservative on the Supreme Court believes Due Process applies at all! So Ozturk deserves her day in court. Why have they not charged her? How long can you hold somebody with out charge?👇👇
