The Plaintiffs' argument is, basically, "you had 18 months warning on when the trial would start. You should've realized the conflict much sooner, and we couldn't move the date because our expert needed to testify on day 1. And, anyway, you weren't making opening arguments or testifying then." 2/3

I once had a time-sensitive case scheduled for argument on the first day of Rosh Hashanah. Opposing counsel (who was at my bar mitzvah) could not obtain client consent to delay the matter. So I filed my motion to reschedule, explaining the importance of the day, and the judge was, like, "of course."

I’d argue that the logistics of the parade would have impacted operations and this closing was the smart thing to do. Not being closed on Yom Kippur isn’t a safety or logistics issue

Doctor wasn't saying "close the courts," but rather "you should've rescheduled the start of this particular trial in deference to my freedom of worship."

I didn’t say they did. I’m saying that the parade causing courts to be closed is not a good comparison in my opinion and should be tossed as an acceptable argument
