Well, you did not mention family, but instead the person who saw the baby in that situation & knowingly refused to save the baby. So that is who I answered about.
Likely many would agree with you. But is it negligence or simply indifference? Most would say he has a moral duty to act but does he have a legal duty? I think it’s somewhat analogous to claims about Brian Thompson being a murderer. Note: SCOTUS ruled police have no duty to protect people.
