COSHH, and associated Approved Code of Practice requires RPE to protect against ALL routes of transmission - especially when the hazardous agent is “airborne”.

Whether or not ‘PREDOMINENTLY airborne’ as mistakenly believed by some of the less competent witnesses during module 3

COSHH Regulation 6 requires that any assessment of risk from biological agents MUST take account of transmission routes and, in turn, inform decisions about the need for RPE.

Such assessments must be revised in the event that new information about transmission routes comes to light.

Healthcare employers have argued that they don’t know how to make FFP3 masks effective in practice, so they want to use surgical masks instead.

Sadly, the Inquiry has effectively elected to remain silent about continued breaches of the law until it reports on module 3 sometime in 2026.
