"For the child born this summer in Texas, whose parents receive no documents, whose name never appears in any system, and who grows up asking why she can’t go on field trips, apply for scholarships, or open a bank account, the consequences are not legal theory. They are her life."

Well this is a pretty huge problem. …and also exactly why privacy folks been warning against normalizing facial recognition in govt the whole time

An astonishing 80 percent of the Louisiana's death sentences between 1976 and 2015 were later reversed. A judge recently vacated the conviction of Chris Duncan, who had been on the state's death row for decades. boltsmag.org/chris-d...

One reason I did the "turn all my decision making over to AI" story last year is that I was curious what's it going to do to us as we turn more of our day-to-day thinking over to gen AI chatbots. This study is small but doesn't bode well: time.com/7295195/ai-c...

SCOTUS's ruling in Skrmetti will push many legal fights about transgender rights to the states -- including whether state constitutions provide additional protections. Read about how state courts have addressed these questions to date. statecourtreport.org/our-work/ana...

Justice Sotomayor's dissent in Skrmetti (which she's now reading from the bench) is deeply pained, accusing her colleagues of abandoning "transgender children and their families to political whims" and badly damaging "bedrock" principles of equal protection. www.supremecourt.gov/opinions/24p...

i just find this so bizarre. searching through texts and doing the reading for myself is how i actually think through ideas! trying to put together a sentence is how i figure out what i actually want to say!

BREAKING: A federal judge ruled all transgender and intersex people can obtain passports that align with their gender identity while the case against President Trump's executive order proceeds. While this is good news, we will continue fighting until this executive order is blocked permanently.

BREAKING: Judge Breyer orders Trump to "return control of the California National Guard" to CA Gov. Newsom, finding that Trump's order taking control was illegal because it did not follow the required procedure. The order is stayed until noon Friday. More to come at Law Dork: www.lawdork.com

This absolutely unhinged exchange is a lawyer for the Texas AG's office arguing that it's totally fine for there to be bugs crawling around in prison food. Amazing stuff.

NEW: We filed an emergency brief asking the Supreme Court to prevent the execution of Anthony Wainwright tonight. The Florida Supreme Court refused to let Anthony file a petition to stop his execution and failed to let him choose his counsel.

This might be some of my best writing, but I’m sure that feeling will disappear when I start editing it.

New from 404 Media: Delta, United, American etc don't want you to know they sold your flight data to DHS. This looks so good.

I wrote 2,726 words today and some of them might even be really good.

At a recent doctor’s appointment, I was handed a consent form authorizing AI use to compile notes. There was no space to accept or reject that tool, such as a check box. I ended up writing it in manually.

This would be a terrible mistake. The failure to turn over evidence is a serious contributor to wrongful convictions.

After finishing grading and other tasks, I was finally able to give "Secrets of the Killing State" by @corinnabarrettlain.bsky.social my undivided attention. This book is spectacularly good. The writing is outstanding. It's accessible for a general audience, but works for an academic one too.

BREAKING: Justice David Souter has died

I was helping 10yo study US History and asked him what the first three words of the Constitution are. He hesitated and my husband said, “Hey, you guys.”

None of this is surprising.

10yo just interviewed me about lawyers and got a lesson in the fun of attorney-client privilege and the duty of candor.

Absolutely not.

Why build trust and intimacy in a relationship through communication and respect when you can buy paranoia and surveillance?

For folks new to the issue, here's the Brief filed by leading Class Action & Habeas Professors explaining that DOJ's insistence that habeas cases can't get class action treatment is wrong. We scoured the earth, there's not a single appellate case supporting DOJ. drive.google.com/file/d/1lWId...

1. In a landmark ruling, a federal judge has blocked the passport ban for transgender Americans... government ban likely violates equal protection, and is made with animus. Though the ruling only applies to plaintiffs, it is expected expand in coming weeks. Subscribe to support my journalism.

EXCLUSIVE: DOGE is knitting together data from the Department of Homeland Security, Social Security Administration, and IRS that could create a surveillance tool of unprecedented scope.
