Interesting. I also believe that the winner takes all context allows for much more of what you call indulgence. Compromise seems to be a dirty word, but is an excellent tool to reign in indulgence.

La loi, toute la loi, rien que la loi. La loi est égale pour tous. Les jugent l'appliquent strictement. Nulle personne, en raison de ses fonctions passées ou de son rôle politique, n'a le droit d'invoquer un quelconque privilège, a fortiori si elle est élue. Tout le reste est nul et non avenu.

Very poor take. Leaving aside that there is no evidence for an electoral backlash, no one should be above the law and upholding the law should not be dependent upon electoral consequences.
