I keep saying this over and over again, screaming into the void: a good portion of the outrageous stuff that is going on under the assumption it will never be prosecuted by Trump’s DOJ *also could be prosecuted by state AGs or local DAs*.

For clarification, the entire court, 8 Ds and 3 Rs, in an unsigned order, granted an administrative stay of the permanent injunction against the IEEPA tariffs ordered by the Court of International Trade. This is a temporary stay while the court considers a motion for a further stay during appeal.

As far as I can tell from talking to Senate procedural experts, this is just wrong and will give a bunch of people false hope that Senate Ds can gum up the works. If the CRA was so easy for the minority to exploit, we would have seen Rs use it constantly against Biden.

I think what has thrown people off is that he's a handful of personality quirks away from being among the worst. As evidence, look at the many Republicans who have tried to imitate him, never get more than 70-80% of the way there, and uniformly faceplant.

My takeaway from this story is that, yes, they're worried, but they're also brainstorming countermoves, which is important. You can't just sit there and be terrified.

Trump's approval rating has declined markedly since his inauguration (and his favorability numbers are down from the election) so it should be trivially easy to find a handful of swing voters who regret their vote. Not doing so is an editorial choice.

I will let no one claim to be a bigger filibuster hater than I, but this seems more like a baby step than full nuclear.
