An opinion by MD Fed. District Court that the various DEI EOs violate the 1st Am. Speech Clause, and the 5th Am. Due Process clause; uses arguments designed by to be used against liberal govt. initiatives (RAV & FAIR) & applies it to these EOs: storage.courtlistener.com/recap/gov.us...

Simple obvious point: Admin opposition to "Equity" amounts to opposition to fairness. Make them answer to that. *(leaving aside, for the moment, D&I).

The EO on Independent Agencies asserts the Pres. and AG's "opinions on questions of law are controlling." The W Bush Admin put John Yoo in the OLC to write memos allowing egregious actions. These had citations, however flawed. This EO doesn't bother: there are no citations to law, & OLC is cut out!

I know that this is not likely to be a surprise but it is important empirical research on the nature of the federal firings.

New EO: "No employee of the executive branch acting in their official capacity may advance an interpretation of the law as the position of the United States that contravenes the President or the Attorney General’s opinion on a matter of law." Too much trouble to fill OLC with lackeys. Congress?

That Wurman/Barnett NYT oped on birthright citizenship mentioned Edward Bates, Lincoln's Attny Gen, for clarification on Black citizenship. My book chapt explains the political context and importance of creating national birthright citizenship. That was the pressing issue, not "illegal immigration."

Make your calls. Go to your town halls. Ask your state and local officials what they are doing under state and local law. Rest. Hydrate. Make soup for the hungry. Don’t let people tell you that you’re doing it wrong. Not a sprint. Not a marathon. A relay. Find your team. Thank you.

Dear Academics: You have enough on your plate with <waves hands at current political situation.> Let me help you by writing an article that is only 28 pages long but covers a lot of ground in an accessible way. 👇

U. Chicago Press is offering a 50% discount this weekend on the 18th Edition of the Chicago Manual of Style. I own the 17th edition. Is there sufficient value added in my purchasing the 18th?

I have a blog post up at Balkinization on Institutional Vandalism. It offers a historical institutionalist (APD) analysis of our current moment. balkin.blogspot.com/2025/02/inst...

I have changed my mind. Let's add Canada. But it is too big to be a single state. So each province should be a state. That should yield up to 20 more Senate seats, plus a plethora of House seats & Electoral College votes. #nothappening

Felonious Trump? (Or is that sacrilege?)

Charles Person, who was the youngest of the Freedom Riders in 1961, has passed away at age 82. With his passing, Hank Thomas is the last remaining of the original Freedom Riders. www.washingtonpost.com/obituaries/2...

I just saw a post on Facebook start with ‘Convicted Rapist Mark Zuckerberg….’ Let’s see how long this no fact checking lasts.

BREAKING: Cannon has blocked DOJ from releasing Smith’s report until further proceedings.

People are rightly up in arms about contributions by Bezos and Zuckerberg to fund the inauguration. I presume a portion will its way to the Trump Organization, which will provide (overpriced) services. Consider the contrast: Musk made an investment; theirs is merely protection money.

Today I realized I am in the middle of 5 books. All relate to parts of my research; yet pull in 5 directions. Am learning about medieval franchises, English Law Before Edward I, common law, quo warranto actions, & The New Industrial State. Must finish 3 before I begin another. #undisciplined
