While I, and maybe you, were sleeping, a SDNY judge granted the TRO sought by 19 state AGs blocking Elon Musk’s DOGE from accessing federal payment systems. The AGs filed for the TRO late yesterday.

"It has become ever more apparent that to our president, the rule of law is but an impediment to his policy goals. The rule of law is, according to him, something to navigate around or simply ignore" - Judge Coughenour rejecting the DOJ's 14th amendment argument, with fervor.

U.S. Deputy Attorney General Drew Ensign is making the argument, one long made by John Eastman, that the 14th Amendment does not confer automatic birthright citizenship because of the "subject to the jurisdiction thereof" clause.

A hearing is underway in Seattle federal court on 4 states' AGs motion for a PI further blocking President Trump's no-birthright-citizenship order. Judge Coughenour has already praised the AGs' legal work and talked about how much he values "the rule of law," which they say the order violates.

Judge Loren AliKhan of the D.C. federal court has issued a temporary restraining order blocking the federal funding freeze, as she signaled she would do earlier today. OMB is "enjoined from implementing, giving effect to, or reinstating under a different name the directives in OMB Memorandum."

Judge Loren AliKhan of the federal D.C. court says she's inclined to grant a TRO blocking the Trump administration's funding freeze, as sought by a group of nonprofits. This is on top of a similar TRO granted by a federal judge in Rhode Island on Friday.

U.S. District Judge McConnell issues TRO blocking federal funding freeze. "Defendants shall also be restrained and prohibited from reissuing, adopting, implementing, or otherwise giving effect to the OMB Directive under any other name or title or through any other Defendants ....

Judge McConnell did not immediately issue a TRO against the funding freeze memo today, tho he said he's inclined to do so. He's told the Dem AGs to draft a TRO, run it by DOJ and then submit it for his approval. No specific timing, tho Dems say they'll act quickly.

DOJ lawyers told a Rhode Island federal judge that a multistate AG challenge to the OMB funding-freeze directive is "moot" because the memo was rescinded. "There is no need for prospective relief—let alone emergency relief in the form of a temporary restraining order." Scheduled hearing starts soon.

Despite the WH's withdrawal of the OMB funding-freeze memo, or perhaps because of some mixed messages coming out of the WH today, Dem AGs are still pressing ahead with their request for a PI. Hearing scheduled in R.I. federal court this afternoon.

A couple of thoughts ... A federal court already upheld many of CA's non-cooperation laws during Trump 1.0. Also, 3 of the 4 Biden-appointed USAs in CA remain on the job. Don't know how much longer they'll stay but hard to see them agreeing to go after so-called sanctuary cities and state officials.
