BREAKING: As Elon Musk said on X would be happening, I can now report that all federal employees are receiving an email directing them to provide “approx. 5 bullets of what you accomplished last week.” It directs them not to send any classified information and is due by 11:59p Monday.

This piece nicely captures the sometimes subtle benefits of legal mobilization in practice—leveraging concessions, building a public record, winning by losing, etc

Chris Geidner at Law Dork nails it: "The mere fact of litigating can change implementation of policy to improve its application to those affected.... Failing to challenge illegal & unconstitutional actions means that Trump & his team will go forward & do more. That is not an option." ⚖️

As per usual, @chrisgeidner.bsky.social has managed to distill exactly what needs to be said. Litigation is crucial. Yes, the courts are captured. Yes, laws are not real. Whatever. We should still be litigating tooth and nail.

Crusades: Trump edition

DOGE’s accounting of its “savings” is riddled with sloppy mistakes. The five largest cuts that it listed on its website earlier this week were all incorrect — making the savings look far larger than they were in reality.

BREAKING: SCOTUS, for now, leaves order in place keeping Special Counsel Hampton Dellinger in office. Trump fired him, but Dellinger sued. The government’s request, however, is being kept before the court — on hold for now — since the TRO is set to expire on 2/26.

NEWS: The Federal Housing Finance Agency has stood up a "DOGE Team" — I hear DOGE people were there Thursday — that's asking for intra-office snitching. Employees were told: "We appreciate everyone who has already provided ideas on how we can streamline FHFA operations and stop wasteful spending."

NEW: Law Dork can confirm that, per a memo sent today from Acting Commissioner Dudek, most components of the office (OARO) are being moved to other offices — and that Deputy Commissioner Gina Clemons, who headed OARO, is being moved to be a "senior advisor" in the Office of Communications.

This is 100% the right call.

Update: The plaintiffs sought to have this before Judge AliKhan as a related case to the OMB grants/loan "pause" case. Judge AliKhan said no in an order this morning, so this case will get randomly reassigned to another D.C. federal judge. Order: storage.courtlistener.com/recap/gov.us...
