My @umichlaw.bsky.social colleague @dtdeacon.bsky.social has an important new paper (Administrative Law Review forth'g) on how #SCOTUS uses agency practice in statutory interpretation. All the more important after Loper Bright: papers.ssrn.com/sol3/papers....

I have a new paper (forthcoming in the Administrative Law Review) on the Supreme Court's use of agency practice to settle statutory meaning. I may do a longer thread later, but here is the SSRN link and abstract. Comments welcome! papers.ssrn.com/sol3/papers....

It was a treat to sit down (virtually) with the Regulatory Review editors a few weeks ago to talk about changes in administrative law and the future of the administrative state. Here's our interview transcript: www.theregreview.org/2025/02/09/s...

After Loper Bright, role of substantive canons in review of agency statutory interpretations should become less complicated than under the Chevron two-step dance. Nancy Morawetz has a fun essay (NYU L Rev online forth'g) exploring how one such canon might work now: papers.ssrn.com/sol3/papers....

DeWine Ohio Constitutional Interpretation and Public Meaning Originalism, https://buff.ly/3Bogo9l Justice R. Patrick DeWine (Government of the State of Ohio) has posted Ohio Constitutional Interpretation (86 Ohio State L.J. (forthcoming 2025)) on SSRN.

This is a critical intervention

"They argue that the panel's analysis improperly revived Chevron deference under a different name, contrary to Loper Bright." More about the amicus brief I filed with Prof. @chrisjwalker.bsky.social www.wilmerhale.com/en/insights/...

Some of my finest work

This is the week of the big game, so I'm reposting the video @umichlaw.bsky.social created to welcome me to the faculty in 2022! 🤓 youtu.be/jWCFaJ0tMfE?...

New from Professor @chrisjwalker.bsky.social on @ssrn.bsky.social

Over at SSRN, Melissa Wassermam, Aaron Nielson, and I have posted a revised draft of our paper Saving Agency Adjudication (Texas Law Review forthcoming): ssrn.com/abstract=456...

Really interested to read this amicus brief from @chrisjwalker.bsky.social & @michaelgkagan.bsky.social, since I'm working on my own take on Skidmore after Loper Bright.

Can confirm! This Ninth Circuit case is extremely important for how immigration and other administrative law matters are dealt with in federal court across the western U.S. We hope the Court takes another look.

The annual Wisconsin Law Review issue on public law in the states is live! Great essays by @oldfatherc.bsky.social, @kmtani.bsky.social, @slwashington.bsky.social, @chrisjwalker.bsky.social, @robyablon.bsky.social and @derekclinger.bsky.social, and more. Wlr.law.wisc.edu/volume-2024-no-5/

Still trying to figure out what Skidmore means after Loper Bright? @michaelgkagan.bsky.social and I just filed an amicus brief with our take, urging the Ninth Circuit to rehear an immigration case en banc: papers.ssrn.com/sol3/papers....

This is a must see symposium on the future of administrative law, featuring a star-studded cast, @chrisjwalker.bsky.social @khickmanjd.bsky.social @sharblock.bsky.social. The best part is that the joy of exploring NYC & the Village will (hopefully) cheer you up after learning admin law’s future.

This is amazing! 🤩 Some #adlaw nerds are popping champagne over Loper Bright, while many others feels like this (created for class by my colleague @dtdeacon.bsky.social) 👇 x.com/danieltdeaco...

Tom Merrill's HLR comment on Loper Bright's overruling Chevron, now up. (He's not on here, or anywhere, so I'm happy to spread the word.) As his biased, former (though losing) counsel, I think it's great! @dbrodriguez.bsky.social @chrisjwalker.bsky.social harvardlawreview.org/print/vol-13...

Looking forward to this exciting event! I’ll be talking about some of the truths and myths about the “traditional” understanding of agency independence.

This coming Friday at the University of Michigan Law School, the Journal of Law Reform is hosting a terrific symposium on the future of agency independence. Details here: www.yalejreg.com/nc/universit...

New to SSRN: My former research assistant Neena Menon and I have posted a draft of our Wisconsin Law Review essay, Chevron's 51 Imperfect Solutions, reflecting on how states should approach judicial deference after Loper Bright: papers.ssrn.com/sol3/papers....

A while back I did a quick explainer video for the Federalist Society on the major questions doctrine. It looks like it's now live on YouTube: www.youtube.com/watch?v=vPn7...

Over at SSRN, I've posted a draft of my Widener Commonwealth Law Review symposium essay, Congress and the Shifting Sands in Administrative Law, which sketches out how Congress might be able to respond to recent changes in administrative law: papers.ssrn.com/sol3/papers....

Over at the Michigan Law website, my colleague Dan Deacon and I have a conversation about the future of judicial review of agency statutory interpretations after Loper Bright. 🤓 michigan.law.umich.edu/news/5qs-pro...

Kristin Hickman, Dick Pierce, and I just finished the summer supplement to our #adlaw casebook. Over at the Yale Journal on Regulation, I share how we're going to teach statutory interpretation in administrative law after Loper Bright (at least for now!): www.yalejreg.com/nc/how-we-ar...

Last week, over at Bloomberg Law, David Zaring and I recommend that the SEC adopt a right to remove in agency adjudication now, in light of the Supreme Court's decision in SEC v. Jarkesy: news.bloomberglaw.com/us-law-week/...

Last month ACUS adopted an important recommendation on Senate-confirmed officials in agency adjudication, which drew three separate statements from ACUS members. I've reproduced Melissa Wasserman and my separate concurring statement over at JREG: www.yalejreg.com/nc/acus-reco...
