David Hawkins clearly lays out what many of us knew would follow SFFA decisions: use of segregationist logic to argue that any increase in student racial & ethnic diversity from pre-SFFA levels is evidence of illegal admissions practices. Effectively, benchmarking data to cap representation.

A federal judge has extended her freeze on President Donald Trump’s plan for mass layoffs and reorganizations at 22 federal agencies until a lawsuit against his administration is resolved, saying the president “likely must” seek approval from Congress before carrying out such widespread changes.

“Nakedly authoritarian and retaliatory” — statement from Harvard’s @aaup.bsky.social chapter on the termination of Harvard’s SEVP certification.

We’re down 70% of the civil rights lawyers at DOJ

This whole thread is great, but I particularly appreciate this idea of a “ladder” of research questions implied by a broader theory (and we should be very clear about which question we are attempting to answer in a given paper)

🧐

This. And you can do the very same thing for IES and the education data infrastructure.

Our latest "Alert" covers all things federal education policy (and law) from the past week. As always, it's a lot... docs.google.com/document/d/1...

My colleague Nathan Arnold breaks down the House Republican's education reconciliation bill in this "Deep Dive": docs.google.com/document/d/1...

Of course these days ymmv on how much this matters, but lots of federal laws (👇) prohibit exactly the type of *federal control* over state and district K-12 curricular decisions that Miller is promising here: educationcounsel.com/our_work/pub...

Check out our latest (jam-packed) EducationCounsel Alert with updates on many important developments in public education including 7(!) new Executive Orders and 3(!) court orders halting some key parts of the Administration's "anti-DEI" efforts: docs.google.com/document/d/1...

cc: NIH (They just announced that all research grant recipients must promise they don't do "DEI" with the same inadequate definition as USED is trying to use here.)

NAACP Legal Defense Fund sues Dept of Education over ongoing destruction of data infrastructure 💪🎉 Suit is on behalf of National Academy of Education & National Council on Measurement in Education LDF has a long and storied history. So honored they are representing NAEd, of which I am a fellow

Beside how awful this is, it also illustrates the reach & limits of executive orders. It does mean DOJ won't do cases based on this (legit) theory of discrimination. But the theory is still legit & others can use it. The EO doesn't *change* the law...just Admin's approach to enforcing it.

Another tiny, obscure corner of the Education Department is scheduled to lose funding this week. hechingerreport.org/proof-points...

Big news

RIP APA

We are fully through the looking glass. Remedies for civil rights violations are now themselves civil rights violations.

Check out our latest Alert with several updates about some pretty significant developments in the federal education world: docs.google.com/document/d/1...

Check out this smart unpacking of the (not so smart) cancellation of billions of federal education funds last week. As @robertgo.bsky.social explains, Secretary McMahon says she trusts states but this action does not match her words.

My favorite sign at #handsoff DC today: “Things are so bad even the introverts are here”

Incredibly important action from IHEP, @aefpweb.bsky.social and @publiccitizen.bsky.social to fight the administration's dismantling of the Institute of Education Sciences. #EduSky www.citizen.org/news/lawsuit...

I know complaining about headlines is cliche at this point, but the difference b/n the headline ("DEI") and the first sentence of the article ("practices that the administration believes illegally promote diversity, equity, and inclusion") is *critical* & key to avoiding preemptive compliance.

Smart breakdown of a coming break down in federal contracting (this is about HHS but it holds true for other agencies for sure)

New: The federal government effectively canceled hundreds of millions of dollars for K-12 school districts nationwide with a letter to states Friday evening. "Shocked does not begin to describe our reaction," Maryland's education superintendent said. www.edweek.org/policy-polit...

Hard to square this circle eh?

I missed this last week

Trump's executive order tonight has illegally cancelled union contracts for 67% of the federal workforce & 75% of unionized federal employees — roughly 700,000 union workers This may be the single biggest attack on the labor movement in American history

This was done via the Congressional Review Act (CRA)...a less obvious consequence is that the agency (here CFPB) isn't allowed to re-regulate unless/until Congress takes *new action* allowing for a new rule in the future. That, um, doesn't really happen anymore.

Today, #GeorgetownLaw Dean William M. Treanor joined 79 law school deans in signing the letter posted below, issued March 26, 2025. [ Those signing are expressing their personal views and are not speaking for their institutions. Find the full letter and list of signatories: bit.ly/4hSna6u ]

In a new letter, AERA and other education research leaders call on Congress to protect the nation’s education data, research infrastructure, and knowledge base, by safeguarding the IES and broader Education Department staff, leadership, and mission. www.aera.net/Portals/38/E...

Exhibit #1735 why I usually wait a bit before sharing where I grew up. “The state’s legislature on Tuesday is set to debate a bill that would loosen child labor laws, allowing children as young as 14 years old to work overnight shifts. “

"We’re not going to be perfect in the first round, but the process is set up to be updated and receive feedback. If you’re reading a piece and have a question, or you want to debate some point, you can click the feedback link and explain it." This is my favorite feature of the Live Handbook.

A little story about buying & selling genetic data in light of 23andMe's impending bankruptcy. (Also told, I must say, in my book, Inside the Cell.) In the late 1990s, the Sorenson Molecular Genealogy Foundation -- a nonprofit aimed at genetic research -- solicited DNA samples from volunteers.

Really helpful explainer from @regleichty.bsky.social on the reconciliation process and how it might threaten various aspects of federal support for education.

Here's our EducationCounsel summary/analysis of the Executive Order on the future of the US Dept of Education:
