If the US is now so weak that it cannot demand the return of a prisoner IT SENT TO A FOREIGN COUNTRY ITSELF, then the US government no longer exists. If, however, it refuses to use its power to return a prisoner, it... still no longer exists. We are no longer the US in either case.
