The only plausible reason for the Supreme Court to rush out its order at 1 a.m. is that a majority of justices refused to trust the Trump administration's promise that it wouldn't secretly deport migrants without due process. That alone marks a hugely consequential shift. slate.com/news-and-pol...

🚨UPDATE: New evidence filed by the ACLU last night shows that the Trump administration is going forward with more Alien Enemies Act deportations in seeming violation of the Supreme Court's clear command that people be provided a "meaningful" opportunity to seek judicial review.

These omissions become commissions.

This is a good thread in general but please absorb this takeaway. The injustices are getting worse. They are also getting more glaring, and the American people are noticing. Keeping talking and keep yelling at electeds.

This is what judges should be doing right now. If the Trump administration is going to insist that it can’t bring back anyone once they’re removed, then federal judges should put the brakes on any and all removals until the *full* legal process—to ensure the removals are valid—has run its course.

The question isn’t whether a federal court can order the Salvadoran government to release Garcia; it can’t. It’s whether the U.S. government has the ability to secure Garcia’s release. If so, then it can be ordered to do so, because then Garcia is in the “constructive” custody of the United States.
