The Scottish Gov can’t appeal because it has no power to do so. S35 of the 🏴󠁧󠁢󠁳󠁣󠁴󠁿 Act gives 🇬🇧 the power. This is about suppression of 🏴󠁧󠁢󠁳󠁣󠁴󠁿 by 🇬🇧. Nothing else. Independence would have enabled this to happen.
