Most U.S. Presidents up to the Civil War wanted the U.S. to establish a national university -- not to replace the others, but as an important principle to bind together the nation and provide leadership with a common distinctly American higher education. To follow up on my appellate procedure skeet a few minutes ago. If DOJ keeps behaving as it has, it is going to refuse to produce the witnesses for deposition, refuse to answer the Rogs, and instead seek appellate or mandamus review from the Fourth Circuit and then the Supreme Court. 1/

What Judge Xinis is banking on is that the government does not want to spend two weeks in discovery. Two big things can happen: (1) They just make the call and get him back (2) They spend two weeks creating a public record of their own fuck ups and then get sanctioned

In Abrego Garcia hearing, Judge Xinis is going to order intense discovery to determine, among other things, whether the government is in contempt and how to proceed next. The plaintiffs had asked for that discovery in this filing.⬇️

Judge Xinis is following exact procedure used in previous cases where cabinet officials held in contempt. See esp. Cobell v. Babbitt, 37 F.Supp.2d 6 (1999).

I don't think I've seen this argument directly made like this in a case since January 20, but other lawyers and judges — and the Supreme Court — should be thinking very hard about this.

NEW: DOJ finally files its response. They continue to refuse to provide any information about any steps they are taking to bring him back, suggesting they are not taking any. They again offer nobody with personal knowledge and simply cite Bukele's (utterly false) claim that he can't do anything.

The NEH hammer has come down on the group project led by Cliff Ando to produce a new edition of Roman Statutes. Most of the team is composed of established scholars in secure jobs, but the funding was also supporting a full-time postdoctoral fellow whose work is *essential* for the project. 1/2

So on Abrego Garcia: 1) We're going to comply. 2) Trump: We can get him back. 3) Trump: No we can't. 4) DOJ: In sovereign Salvadoran custody. 5) Backsies on the judge's 2019 ruling which Trump 1 didn't contest. Have I gotten all the shifting positions correct?

NEW: A second filing today from the DOJ tells Judge Xinis that in their view, since Mr. Abrego is in Bukele's custody, she can't order them to do anything further to bring him back since that's not what "facilitate" means. They also say the deal with Bukele is classified and/or a state secret.
