Posting tonight ti shine a light on what the Alien Enemies Act looks like IRL. Our @immdef.bsky.social client fled Venezuela last year & came to US to seek asylum. He has a strong claim. He was detained upon entry because ICE alleged his tattoos are gang related. They are absolutely not. 🧵

Bukele said he will imprison the men and they will be subjected to forced labor. So with this action, we are in violation of our obligations under the Convention Against Torture.

Our laws allow for the deportation of non citizen gang members, but not to another country that is not their own, where they will be subject to imprisonment and torture. Also, these men have not yet been proven to be gang members.

There is no declared war between the U.S. and Venezuela, and El Salvador is not at war with Venezuela either. So it is not justifiable under any legal framework. This would also be against international humanitarian law if there was a war.

It would be a violation of human rights law even if they were not sent to a prison that is internationally notorious for abusive conditions, torture and forced labor. Just the act of deporting these men tl a country that is not there own violates international human rights law.

Let's be clear. The actions by the Trump Administration to send 238 Venezuelans to El Salvador, a country where they don't have citizenship and had not agreed to be sent to, is a gross violation of international human rights law, not to mention a violation of a Federal judge's court order.

For my Venezuelan compatriots directly affected by this assault: 1. Do not comply in advance. Instead, lawyer up. 2. Revoking TPS is likely illegal but he will probably get away with ending renewal. So you needed a new plan anyway. 3. Asylum, which is based in law, isn't such a bad plan.

Why are so many of us Venezuelans surprised that Trump, an authoritarian populist, would negotiate with Maduro, another authoritarian populist, rather than support democracy? Also, since when is right vs left more important than corruption, right?

Just a reminder that executive orders are NOT laws. Laws are passed by Congress, or by state legislatures. Executive orders aren't ruled either. Rules are issued by agencies after rulemaking processes, typically things like "notice and comment." Consult a lawyer before you comply in advance.
