Just a great time for all the liberal justices to be spelling out how deferential we should be to legislative and executive branch assessments of "national security" interests even if they result in huge speech suppression.

Be wary of fast & loose media coverage of the GAI copyright cases as they move through the courts. Neither MSFT nor Open AI has moved to dismiss direct infringement claims going to model training in the NY Times lawsuit. Fair use won't be argued on Tuesday. www.law360.com/ip/articles/...

Never, ever let anyone tell you that there is no "moderator's dilemma" in the U.S. because of Section 230. Not when it took Vimeo SIXTEEN YEARS of litigation to defeat claims that ordinary content moderation created "knowledge" or "control," hence forfeiting the DMCA safe harbor for copyright.

I’ve been focusing on this issue for nearly 20 years. Trade secret law is blind to the public’s interest in info, and that’s a problem. If the reporter had contacted me, I’d have focused him on that simple fact. It makes trade secret law the most powerful IP law for preventing info access.

This is the way.

The marketplace of ideas only works when people are allowed to freely debate important issues AND the best ideas emerge and spread.

If you try to use #ChatGPT, EVEN the "SearchGPT" function, with #Boolean keywords, you will utterly fail. It is a whole different type of searching the web (and again, you ONLY do that with " #SearchGPT," NOT regular ChatGPT). #onlineliteracy #infolit reedhepler.substack.com/p/understand...

On remand, the district court in the Bad Spaniels dog toy case holds that the toy is a parody that doesn't confuse consumers, but DOES tarnish the Jack Daniel's mark by associating it with poop. This is an unfortunate consequence of the Supreme Court ruling allowing the dilution claim to survive
