Truly frightening to see civil-military relations experts be so distraught today. I hadn't understood that no POTUS has ever replaced the top brass 1 month into office plus fired the JAGs. We’re in autogolpe territory, more so if Trump changes the head of Northern Command.

People are making the comparison between this and the British in the lead up to the American revolution, but the better analogy is probably the Bostonians resistance to slave catchers, including U.S. Marshalls, in the 1840s and 1850s.

Quick someone take away Alito's computer until Monday at 11:59pm. (Who knew it would be that easy?)

Over at @justsecurity.org, I have a really short post discussing the latest OPM email. Two takeaways: (1) Musk continues to use private-sector tactics to manage the civil service. Those tactics don't work. (2) No. It's not a resignation. www.justsecurity.org/108229/what-...

This is horrific to see. And any news organization that resorts to any sort of euphemism to describe this is absolutely failing everyone.

I really can't believe I have to write this, but the judiciary is an entirely separate, independent, unrelated branch of government. Neither the President, nor OPM, nor Elon Musk, nor any of the Musk minions, has any authority of any kind to order any of them to do anything.

I still can’t believe that Donald Trump berated a governor and said “I am the law” yesterday. And it was like the fourth most important news of the day.

This book, by my colleague Steve Lubet, has a series of delightful stories about Boston's response to people like Homan. Suffice it to say that they are not friendly. www.hup.harvard.edu/books/978067...

Imagine being an Article III judge and you get this email on a Saturday night lol

If you’re cheering for a South African sociopath to fuck over US military veterans then you should probably stop with that America first bullshit.

America created one of the best knowledge-producing university systems in the wake of World War II, and we are seeing it decimated before our eyes. It’s been under attack for a while, but now it’s a full-on assault.

The works that come out of the new NEH cycle: • A Glorious March to Freedom: How Great Men Built America Without Any Complications • Manifest Greatness: The Inspiring Story of America's Perfect Journey Forward • Founding Fathers and Other Flawless Figures: America’s Unblemished Path to Glory

Interesting thing for the President to say about a person who, according the government’s lawyers, “has no actual or formal authority to make government decisions himself” and “only has the ability to advise the President, or communicate the President’s directives.”

I have the text of the email. It says: "Please reply to this email with approx. 5 bullets of what you accomplished last week and cc your manager. Please do not send any classified information, links, or attachments. Deadline is this Monday at 11:59pmEST."

"Still, the firings have bewildered federal employees like Powell. If their mission is to reduce government waste, she said, it doesn’t make sense to get rid of auditors like her tasked with detecting fraud." www.nola.com/news/louisia...

"We need new people to run for office!" is awesome and I support it, but even at the local level, political newcomers have to overcome a lack of name recognition, donors, and connection to gotv networks. Many new candidates with great ideas go totally unnoticed, beaten by better-known do-nothings.

When this movie was first released, I thought this bit was a little too on the nose. I’ve come to appreciate it a lot more ever since.

The House could vote next week on drastic cuts to Medicaid that would gut critical programs that protect the civil rights and dignity of millions of Americans — including people with disabilities. Contact your member of Congress: No cuts to Medicaid.

Trump to fund new National Endowment for Inhumanities

The National Institutes of Health had to stop considering new grant applications, delaying funding for research into diseases ranging from heart disease and cancer to Alzheimer's and allergies.

While we’re standing up could we also stand up for the humanities who can help explain how we got here and why we shouldn’t cave?

None. Absolutely none.

one might say “deplorable”

W.E.B. Du Bois on the white takeover of southern public schools after Reconstruction. Not a coincidence that the chapter, "Back Towards Slavery," follows his analysis of the eventual dedegration of the public school system. Attacks on education are vital to (re)instituting authoritarian rule.

I wrote about how particularly ridiculous it is that Senate Democrats, led by Dick Durbin, think the priority should be repealing Section 230 and undermining the very open internet we need more than ever right now. www.techdirt.com/2025/02/21/w...

The focus of Democrats like Durbin and Klobuchar on doing away with 230 while the republic is being destroyed right in front of us is just part of the world-class point missing that has become the Democrats' trademark.

I have verified it. It is false.

It’s nonsense—but deliberately. The terms are vague and meaningless so they can ban ANYTHING if they want to.

Me, returning home after a week-long training institute: “Wow, I’m exhausted.” 7YO: “Now you know what my life is like.”

I am not going to tell anyone not to pay their taxes. It would be funny, though, if everyone filed paper returns and submitted paper checks.

this is evil

Just as long as you don’t want to do anything about race, gender, equity or diversity. It is heartbreaking that an actual humanities funder would precapitulate to the fascist dictatorship. What are the humanities for if not to teach us how to RESIST!?

I discuss in my book chapter how the ABA intentionally lowered bar exam passage rates and mandated particular accreditation requirements to decrease the number of law students and lawyers of color after they couldn’t overtly discriminate. They’ve never been at the forefront of inclusion or equity.

This is the federal government actively facilitating rapes and murders against a disfavored minority group. A profoundly evil policy.

I'm so here for the woman who shouted "illegal as hell" after this asshole referenced the birthright citizenship order. Can we find her and give her money to run a primary challenge?

On the theme of constitutional failure and emergency, see this piece by my friend and colleague, Johann Neem. My one reservation is that I would place the Impeachment Clause atop my list of failed provisions. jneem.substack.com/p/donald-tru...

It is an extremely challenging time for higher ed, and I don't envy institutional leaders at this moment, but I am nonetheless deeply disappointed by this decision & the lack of communication to faculty about why it was made: www.thedp.com/article/2025...
