What the judge is doing here is using the authorities that are most clearly within her power to make life extremely difficult for the government and keep the case in the public eye. People can reasonably disagree, but I think this is the most effective way of getting compliance.

They were indeed very conscious of this distinction and it was carried through to the 14th Amendment. Within literally the same sentence the privileges or immunities clause applies to "citizens" and then twice "any person" for due process and equal protection. They knew what they were doing with it.

A big part of the problem, I think, is how many people have posited that it's not Real Lawlessness until Trump unambiguously violates a court order. And that misconception is very much the fault of the lawyers and legal commentariat over the last ~ 75 years.
