NOW: Judge Lamberth DENIES Jan. 6 defendant Russell Taylor's motion to withdraw his guilty plea to the obstruction count. Lamberth says as an "appeal to basic fairness," Taylor's argument has some force, but legally "it is fruitless." Link: storage.courtlistener.com/recap/gov.us...

ICE's reversal comes a day after Judge Nichols warned of a "slippery slope" where the agency could terminate any foreign student's SEVIS record for any reason at all. An attorney for DOJ said he wasn't in a position to say if ICE saw "any boundaries" on its authority.

You see plenty of self-righteousness in filings from DOJ all the time, but the sheer level of indigination in these immigration cases — even here, after losing at the Supreme Court — is something else.

NOW: The DOJ says it can't meet the deadline (an hour ago) to respond to Judge Xinis' order in the Kilmar Abrego Garcia deportation case. Xinis sought a supplemental declaration about where Abrego Garcia is and what steps have been taken to return him to the U.S.

The panel for today's arguments before the D.C. Circuit will be Judges Karen L. Henderson (H.W. Bush), Patricia Millett (Obama) and Justin Walker (Trump). Each side gets 30 minutes to argue, although that number is flexible if the panel has questions.

Hours before the D.C. Circuit hears argumenst on the Trump administration's (now 10-days-old) emergency motion to stay his TRO, Judge Boasberg denies a motion to vacate. Boasberg finds even the "awesome power" of the Alien Enemies Act is subject to judicial review.
