I posted earlier on this issue but no-one wanted my ode to Judge Souter, but the Roberts Court in this and other cases (Dobbs, FAIR) has a tendency to unleash bureaucratic chaos with incoherent decisions. It is going to be a nightmare to enforce this distinction between trans kids and cis minors.

I recommend this Congressional Research Service report on the ways in which the Speech and Debate clause operates, particularly when members are not physically on the floor of Congress, sgp.fas.org/crs/misc/R45.... This might be why the statute clarified Congress could oversight at a facility.

I wanna point out to everyone we have a federal holiday literally called Juneteenth that celebrates freedom from tyrants. It is on Thursday this year.

In just one week: A GOP president deployed Marines in a U.S. city, called for a Democratic governor’s arrest, the GOP Speaker called for him to be tarred and feathered, a Democratic senator was handcuffed, and two Democratic legislators were shot in their homes.

What is interesting to me is that employers who are not in these the favored industries—restaurants and construction come to mind—have a pretty solid case that this violates the Equal Protection Clause. Once again, the President chooses the pretense of power over a grounded legal claim.

@jamellebouie.net notes the Trump Admin is the closest thing to an Elected Confederacy. This is why good opinion writers are like gold. I would add that in my Feed, I have called this the Master’s Law, and it has its own legal sources.

What did Micheal Kinsley say: a gaffe is a politician who is telling the truth. The Trump Administration’s latest brief has no Table of Authority. This mistake tells the Administration’s position on the rule of law.

We can stop playing catch-up if we accept that any legal claim is a distraction meant to hide the claim to power. A logical question then follows: if we cannot accept the Administration’s legal claims does that mean any action it takes is potentially illegitimate?

After spending January and February sprinting to research claims by the Admin, I learned one lesson: do not comply with their legal demands. Treat them like AI hallucinations. To paraphrase Toni Morrison, the function of the law in the Trump Admin is to distract from some horrible political goal.
