When you think about the institutions that would be hit hard by the cap in indirect costs from NIH, you quickly hit on research powerhouses in red states: the Cleveland Clinic, MD Anderson, UAB and more. They are core economic drivers for their states. Will this be considered?

That this is basically coming down to courts and protests seems to me a grave indictment of the constitutional system and the quickly collapsing legal-political order.

What the National Archivist does/does not do makes a difference only to the extent that people act as if it does. The ERA has either been ratified or it hasn’t under Article V, which does not condition ratification on the Archivist’s decision. Nothing the Archivist does can change that.
