One very effective thing that prosecutors always do, and criminal defense attorneys rarely do, is reference jury instructions in closing. I've read a couple hundred felony transcripts. In the vast majority, defense attorneys don't even reference the instruction for doubt.

A fun thing I tried this week at a trial. During Voir Dire I asked the jurors who was familiar with what a "false positive" was. Everyone raised their hand. I had a physician in the jury pool explain it. First question to officer: "What is false positive rate of test?" /1

The biggest difference between Garcia and your average J6 defendant is that no one found child porn on his computer.

Having tried a few cases now, I suspect that, past a threshhold of basic competence (filing appropriate motions, getting appropriate instructions, reminding the jury of those instructions in closing) we are probably exaggerating the effect of skill. It's just, many lawyers are below the line.

Just got an acquittal on all counts, including the count I conceded built on. Jurors filled out the form wrong but it was unfixable because no one polled them and one of them left the building. I'll take it!
