This is splitting the baby, in everything the metaphor implies. It dulls some immediate pain threatened but not enough. And it puts the union in an impossible position, jurisdictionally, which it shouldn't be given the APA claims against the agency re: DOGE's meddling. Those belong in this court.

This lawsuit is about the June 2024 asylum restriction that Biden put into effect, which was justified in part by the existence of alternate legal pathways like CBP One. Eliminating that pathway now makes this regulation less defensible. Trump will aim to replace it, exact method still unclear.
