"I realised that fighting to see Jacob locked up for longer would have served nobody. Him sitting in prison wouldn’t bring my James back and prison had done no good to support or rehabilitate Jacob."

Motor murder case. www.bbc.co.uk/news/article...

I was interested to see this death by dangerous driving case was determined by judge alone (no jury), giving a 143 page list of reasons for conviction (awaiting sentence). www.abc.net.au/news/2024-12...

(Pre-)Ordered. Looking forward to August!

No mention of the penalties received in these cases, if any. Last week I observed a case at Leicester magistrates court where a new driver drove at 61mph in a 30mph limit. He received a 28 day driving ban and fine. www.leicestermercury.co.uk/news/leicest...

The reason for Rule 201 of the Highway Code is visibility. In my PhD I came across at least one case of a fatality resulting from reversing out of a drive. This shocked my PhD supervisor into changing his parking habits by reversing in. Most drivers don't. www.birminghammail.co.uk/motoring/mot...

Nice to see a balanced piece of reporting on sentencing of a tragic case (albeit not 100% accurate). If he was 'banned' from driving, why did he not face a charge for death by disqualified, (max penalty for which is 10 yrs) rather than unlicensed, driving? glastonbury.nub.news/news/local-n...

www.thestkittsnevisobserver.com/government-o... Interestingly, alongside these legal changes, the public will be able to submit journey cam footage to the police as evidence of driving offences (like Op Snap).

Webinar tomorrow- Road death and the pursuit of justice. Still time to register.

I was interviewed on Radio 4's World at One today on the RAC report on motoring's findings about speeding. You can listen to the interview here, from approx 40.30mins. We need to recognise the impact of road user attitude and behaviour on everyone's safety www.bbc.co.uk/sounds/play/...

We have a copy of this book to give away. To be in with a chance to win, repost this message Sentencing Principles, Procedure and Practice 2025 Winner, randomly chosen, will be announced on 17th January

This looks really interesting, and relates to one of my posts yesterday. Unfortunately I don't subscribe to be able to access the full article (although I get the emails), but something to find out more about.

I have now deactivated my X account.

Am I naïve in thinking a Police and Crime Commissioner should check the status of the law before calling for change? The CPS can charge manslaughter, but any conviction would not lead to a higher sentence than causing death by dangerous driving under the current sentencing guidelines.

Apparently it's time to stop work!

We need better regulation of e-scooters, as recommended by PACTS www.pacts.org.uk. But simply adding more criminalisation to existing offences clearly isn't going to work. How do you "make" someone wear a helmet to do something they shouldn't be doing in the 1st place? www.bbc.co.uk/news/article...

Is a justice system accessible if most people don't respond to being prosecuted? That's what happens in the case of the Single Justice Procedure, now used for majority of all prosecutions. Most people don't plead guilty/not guilty & are convicted in their absence www.telegraph.co.uk/news/2025/01...

Note that none of these women were killed with a car, from what I can see. Should we include those whose death was caused by driving as cases of VAWG? Or do we only include such cases where it is clear the vehicle was used as a weapon, with intent ? 1/4 @ianloader.bsky.social

Catching up with news reports on death by car. This has very similar facts to R v Meeking [2013] R.T.R. 4, prosecuted as unlawful act manslaughter (CoA had suggested GNM better charge). D in argument with V, pulled on handbrake whilst she was driving. 😔 www.merseyside.police.uk/news/merseys...

When life imitates problem questions set in undergraduate exams for criminal law modules (this is very similar to the facts of a problem we set in 2023!). #AcademicSky www.bbc.co.uk/news/article...

I don't always agree with the comments on stories. But I do in this case. My concern is not so much with whether the sentence would be higher for careless/dangerous driving, but the message this sends to drivers generally. We need to connect use of a mobile phone with danger. road.cc/content/news...

Nine years for laughing gas crash driver who killed his friends

I’ve put together a Criminal Law (Adjacent) Academics starter pack for anyone working on criminal law related topics. Let me know if you’d like to be added or be removed, and feel free to share this along to others who might be interested in following! go.bsky.app/sdCgVu

Interested to see the take-up of this tech. In an ideal world we would want more officers on the roads. For those interested, Briggs et al (not on bsky 😌)have researched how the few existing officers choose whether to give a "bloody good telling off":

I believe it comes down to drivers ignoring the speed limit.

Disappointed to see the @theguardian.com failing to follow the Road Collision Reporting Guidelines: www.rc-rg.com/home Headline is OK - but see first line (repeated in another report yesterday): www.theguardian.com/football/202...

"The Commission last considered homicide law almost 20 years ago. " This just makes me feel old (which is fair). Nevertheless, a further review has been needed for some time now. I look forward to engaging with the consultation process.
