Judge Xinis is following exact procedure used in previous cases where cabinet officials held in contempt. See esp. Cobell v. Babbitt, 37 F.Supp.2d 6 (1999).

One difference between a press conference and a deposition is the latter is under oath with the penalty of perjury.

NEW: Judge Xinis authorizes up to 15 interrogatories, 15 document requests, depositions from all govt declarants (Cerna, Katz, Kozak, and Mazzara) and up to two others to assess what the govt has done to "facilitate" Kilmar Abrego Garcia's release storage.courtlistener.com/recap/gov.us...

Judge Xinis in Tuesday eve order homes in on key issue: "Abrego Garcia appears to remain inexplicably detained in CECOT." She cites text in written agreement with El Salvador showing US control: That detainees are kept in CECOT “pending the United States’ decision on their long-term disposition.”

Didn’t get a chance to post this earlier, but there was a huge turnout in support of Kilmar Abrego Garcia at the federal courthouse. From my seat in the jury room, I heard the supporters outside chanting throughout the hearing.

There’s just so much shady shit in this story, but this really sticks out. Folks in NLRB’s IT unit were so freaked out by what they saw DOGE doing that they wanted to notify the Cybersecurity and Infrastructure Security Agency. Then this happened:

I was just reminded that this administration had no problem facilitating Andrew Tate's release from custody in Romania.

What was that line of about 30 closely-spaced satellites that passed over our house about an hour ago? Elon, or something else? Is there #astronomysky #satellitesky?

“At this time, we believe they were unjustly arrested,” said Essence Johnson, chair of the Cobb County Dems. “People are passionate now. They’re upset. They’re frustrated. They believe democracy is being taken away from them.” #gapol ajc.com/politics/pro...

This is the second video of ICE agents shattering a window in the last week rather than have some patience. And in this case, they're allegedly detaining someone who already has asylum through his wife, with no reason given at all! www.borderreport.com/news/video-s...

This is positively Soviet. Vera is a nonprofit organization that funds lawyers for indigent people. The government sought to embed people there like political commissars, and only pulled back when they found out Vera's federal grants had already been cut. www.washingtonpost.com/national-sec...

Then y'all shouldn't have him out there as a witness. This is basic stuff. Goodness.

"Why bother putting us to the point of returning him and meeting the burden of proving the allegations we've made against him, we're just going to violate his rights a different way," todays Justice Department, folks.

"If he manages"

I want to tell you why the case of Kilmar Abrego Garcia should matter to you. The one power you cannot give the executive is the ability to imprison or expel anyone regardless of their legal rights. That is our key check against autocracy. And we are watching it disappear.

the immigration court's determination that Mahmoud Khalil *can be deported doesn't necessarily mean he *will be but it still greenlit political retribution against legal residents who exercise their free speech rights and *that means all Americans are in danger ballsandstrikes.org/law-politics...

🚨 This is good. Both @vanhollen.senate.gov and @booker.senate.gov are getting ready to go down to El Salvador. Now @[email protected] have asked House Oversight chair James Comer to authorize Cong delegation to El Salvador. Keep the pressure on Ds. Be relentless.

The DOJ lawyer who made the mistake of answering the court's questions about Abrego-Garcia candidly (eg yes he was mistakenly deported, a fact the Administration already has acknowledged), which got him put on administrative leave, has now been fired, ending his 15-year DOJ career..

It's genuinely hard to express to sort of normal not politically plugged in non-lawyers *how* lawless the Trump administration is, and I think that's some part of the problem. You sound like you're hyperventilating, but it's just a flat description of what is going on.

He is a union apprentice and raising three special needs kids, two of them from his wife's previous relationships so yes he is certainly in the running.

SCOOP --> The cop who initially attested to Abrego Garcia's alleged MS-13 membership was subsequently suspended and indicted for serious professional misconduct: Sharing case info with a sex worker. This undermines Trumpworld's smears. New piece from me: newrepublic.com/article/1940...
