Bij directe discriminatie op grond van nationaliteit is geen systematische ongelijke behandeling nodig. 1 ongelijke behandeling volstaat om tot discriminatie te besluiten (rechtvaardiging is immers niet mogelijk). Alleen bij indirecte discriminatie is het zinvol om een systematiek te zoeken.
