ICE (or maybe DEA? who knows?) shows up again in the same quiet Berkshires town, at a landscaping job site.
This time business owners confronted the agents, demanded they show warrants or IDs. The agents refused.

What I’m taking away is that by *bringing the second employee inside*, documenting encounter & making it clear she was aware of current Fed law, the employer prevented the apprehension of that person since feds had no judicial warrant & could not legally enter w/o her consent. Yes, without a valid arrest warrant, issued by a neutral magistrate (i.e., judge) upon probable cause, an agent of the state is barred by the fourth amendment from entering into private premises absent consent (or exigency that is not agent-created).

Agreed. And how I wish KYR trainings were still enough. I’m focused on the employer’s active documentation of the encounter + her vocal assertion that she’s aware of the law & aware that the agent would be violating it if he were to enter. I think that THAT, not 4A, made the difference.

Yes, but her vocalization was based on the Fourth Amendment, which doesn’t operate by magic/automatically. Without that constitutional amendment, her assertion would have been ineffective to repel intruders. As it was, they couldn’t argue with her righteous recitation of the legal rights at play.

If they had one, they would have entered the restaurant to apprehend the second worker, who hid inside. That they did not enter, and also did not produce a warrant upon request, supports the determination that they did not have a valid arrest warrant.
