To be fair, in the second case, the deal was done in state court. Not fed court. The federal case was settled for 90 life sentences. The state case was screwed up by 2 consecutive DAs, the last being a Republican. So closure beat restitution with the consent of the victims' families.

It may be possible the push for the death penalty is a bluff to scare Luigi into a plea deal to ensure he gets a life sentence without having to go to court. What makes this probable is that it would be a challenge to get an impartial jury and present actual evidence to prove him guilty.

They'll never be able to undo the trial, no matter what they do to Luigi (or to his lawyer.) They won't be able to stop the words used in defense of Luigi- including some numbers/info we don't yet have access to- from ending up on public record. The health insurance murder scheme will be on trial.
