You can't inside trade on published information. If he knew the tariffs were going to be dropped, the tweet itself could be a crime. All the people who knew before the tweet and traded would have inside traded.

Only those who knew in advance from non public sources, or whom had been told that post would signal a turnaround would be guilty of insider trading. I saw that, and I saw a presentation yesterday morning by a trading house suggesting something had to give and worth a punt on out of the money calls.

I'm qualified in regulation and compliance by the London stock exchange. There probably was insider trading on this news, given the shambles here, but trading on that post alone is not insider trading — the fact of the post was public.

He could still be committing a crime if he'd told people such a post would advise of imminent change. Facilitating insider trading is not a presidential duty. This isn't his biggest crime this week.

It was irresponsible disclosure. There may be a wide group who *knew* this post meant change was imminent and traded on it. Any such person would be insider trading. Any member of the public not specifically in the know would not be insider trading. You don't need to be a lawyer to understand that.
