At 12:30 pm ET, the appeals court is expected to hear argument on Trump's petition to halt his sentencing hearing scheduled for Friday.

Yeah, the Court of Appeals in Albany is above appellate and he's still got 2 full days so I suppose he'll go for it. And is probably drafting the cert request simultaneously.

Seems like a lot to go through to avoid a wrist slap.

SCOTUS is reluctant to hear state criminal cases for - reasons.

State & fed powers are divided.

Feds usually want a fed question before elbowing in.

Feds also prefer any & all state procedures be exhausted first.

Lately SCOTUS trends down here.

Yes, in the sense that you can always petition a higher court to intervene, but no, not in the sense that he has any right to another hearing or any consideration by any higher court. I'm guessing he'll try at the NY Court of Appeals.
