They can both sue and honestly the brother not elected has a very good shot at winning because he is not an elected official so lower burden but I do criminal defense so what do I know? All my clients would be under the jail if they did any one of the things TFG has done.
Further he was actually convicted on 34 felony counts. My clients who have faced just one or two of the same type of charges serve at least some active jail time for each count less anything I can negotiate to dismiss. The key there is that to negotiate you have to admit guilt.
Since he’s not admitting guilt he should be subject to the maximum penalty allowed by law on each count with the Judge having final sentencing authority. Idk how state level sentencing works in NY but that is how it works in the state where I practice.

So that’s a hard question to answer in a vacuum. I will say that allegations of sexual assault are handled very seriously and in what I have seen of the civil case against TFG if my clients were facing that evidence they would be convicted. I handle a lot of sex crimes cases.
