Yeah! And this too from Kyle Cheney!
"BREAKING: A federal judge has blocked the Trump administration from dismantling the Department of Education and ordered the administration to reinstate employees fired in a mass termination.
This can't happen without cnogressional approval, she ruled."
It’s good but not great. When it comes around again in a couple of years, Barrett will probably vote for it. If the composition of this court stands, then it actually portends the dissolution of the Constitutional wall between the Christian religion and the government, but wygd?
Maybe a non-Christian religious school should bring the same lawsuit so Christian taxpayers will have to pay for religious schools of a different faith. Would the Justices rule the same way?
You would think that it is a no brainer, the fact that it was 4-4 is mind boggling, particularly the mantra that some of the justices say they are originalists.
Won't matter once Trump's bill has passed into law.
The bill has a clause that prevents any US court from blocking a presidential action. Once the bill is law, Trump can do whatever he wants, with no restraint on him by the judiciary.
Once the bill passes Senate and becomes law, Trump can ignore any injunction placed on his activity and he would be acting within the law. The courts can't prevent the Congress from passing a bill into law.
Noted but I'm not sure that would fly. Admittedly I come from another jurisdiction, but traditionally, the judiciary are very reluctant to cede power on anything, because they know they're the guarantors of constitutional law. They would likely view a challenge to such a constraint very favorably.
Excellent points, but don't discount the power of moral suasion with the electorate. Unless of course, you think that American democracy is a thing of the past...
Nice. I suppose that would have meant tax payer money going for bad education and religious indoctrination quite likely of the anti-democracy, authoritarian, pro-terrorism Christo-fascist variety.
I only chances are almost non-existent but if Democrats ever regain the presidency and the Congress with a supermajority they need to increase the Supreme Court to 13.
Very true, my friend. But I honestly don’t think we can afford to live our lives in constant fear of what the Republicans might or might not do. We can't give them the satisfaction of knowing they've frozen us into fear.
Honestly, I think the bigger story is that religious charter schools came within one vote of being a thing when, presumably, four Justices who have the nerve to describe themselves as "Originalists" see this a Constitutional. This willingness to dispense with a century of precedent is shocking.
Agree. They will regroup and the lawyers will earn more to find a similar but different spin on it. I do not recall all the reasons our country was founded (I am over 60 so my early-years public education on this was forever ago) but even I know separation of church and state was a big one.
It should be 9-0 and all Charter Schools shuttered with students transferred to public schools and educators where warranted job interviews within public school districts.
Shockingly she’s starting to look like the new Roberts - enabling the far-right while always disappointing conservatives enough to maintain credibility.
If Oklahoma finds a different law firm to represent a new effort, then Barrett may join a majority, leading to a 5-4 opinion that guts the Establishment Clause. It’s disturbing that The Court was split 4-4 in a case that, a decade ago, would likely have been 7-2. It should have been 8-0 this time.
The Government was created around the idea of Religious Freedom and the importance of SEPARATING CHURCH and STATE. If our Religions DO NOT receive Government Funding WHY SHOULD RELIGIOUS EDUCATION?
I dont agree with many of Coney Barrett's rulings, but I am starting to respect her. Thomas has never recused himself, although there are so many cases which he should have. As he's on the take, he never will.
The fact that this wasn't a 9-0 fucking vote is proof that the religious extremists need to be deprogrammed. This country is NOT a Christian nation nor has it ever been
It’s crazy it came to a 4-4 decision… it should have been a no brainer this wouldn’t pass. That’s what really blows my mind how close we are to a handmaids tail like country more than a free one.. we are literally on the human rights watch list now.. the HUMAN rights watch list!!
Obviously I offended you. I am extremely sorry I misread your post so LOL on me. 4-4 to me meant where is the 5th judge? Also how do you know she would vote against the bill. Integrity on this ONE case is to recuse yourself if you have a conflict unlike alito and Thomas which was my point.
Now that they did all the research they give themselves time to make a more refined judgement the next time this makes it to SCOTUS again, and it will. And they give the other their side a chance to make a better argument. It's all part of the plan. Root out the areas of problems then try again.
Oklahoma consistently ranks low in national education rankings, often placing in the bottom 10 or 20. Recent reports indicate Oklahoma as second-to-last in public education.
Oddly enough, we have ACB to thank for this. Her willingness to step aside due to a conflict of interest is above board and more than any of the other GOP Justices would or have ever done.
THIS is why they don’t want to do stuff out in the open. They’d rather flaunt rejection of the rule of law than ask permission…Not willing to risk losing.
Maybe they read Memorial and Remonstrance Against Religious Assessments. I’d be willing to bet all of the justices know this document from James Madison.
No. Not big. It will come before them again in another case. Coney Barret won't recuse herself because she's pals with a backer of the cause like she did this time, and it will be upheld.
4 current Supreme Court justices are possibly illiterate or intentionally going against the Constitution for which they have sworn an oath to defend and protect as their job description.
They can give Joel Osteen and the other mega rich churches a call to fund them instead of having homes worth millions of dollars, fancy cars, 20 car garages, face lifts, Botox, etc, etc!!
This very important the religious fundamentalists who want to indoctrinate children ignore the bloody wars which occurred during the reformation.
Christianity Nationalist are already assaulting the Constitution and destroying the economy.
You can’t have Freedom of Religion without a Government Free FROM Religion. The founders were wise to separate church and state. Here’s the pledge before that separation started to unravel.
Barrett recused herself from the religious schools case, likely due to her close relationship with Nicole Stelle Garnett, a Notre Dame Law School professor who was an early advisor for St. Isidore of Seville Catholic Virtual School, the school involved in the case.
But only because Barrett recused. Another case will come up and now we know there is a 5-4 majority to overturn the Establishment Clause and rewrite yet more of the Constitution by judicial fiat.
In FL, vouchers are publicly funded and are currently allowed to be used for religious instruction. I wonder if this will affect those. It should. I don’t want my tax $$$ to continue to fund this.
It is, but it shows just how fucked up the USA is right now. 4 fucking SCOTUS judges supported this bullshit, which is so obviously unconstitutional it's literally insane that they're trying to cram it down our throats.
It's crazy to think that four of those taint-licking justices would think this is ok. The fucking constitution is nothing more than ass-wipe...currently.

It was a 4-4 decision. Judge Amy Coney Barrett excuses herself.
As it is a draw, the ruling from lower courts still stands, but is not overruled by SCOTUs and hence not binding die other states.
But this is my understanding. Correct me when I'm wrong

The bill has a clause that prevents any US court from blocking a presidential action. Once the bill is law, Trump can do whatever he wants, with no restraint on him by the judiciary.
If Trump chooses to ignore them - perfecty legally once this bill is law - the judiciary has no power to compel him to obey.
The judiciary doesn't control the military or the money.
That's fucking frightening.
They're just conservatives.
Spot on, Magnus.

Too close for comfort
Never should have reached the Supreme Court.
But I’ll take it, in these desperate times.
I mean, it works for the 47 regime all the time.
It's 1 step forward, 4 steps back.
Just wait, Fred, just wait.
And I'll take what I can get.
Apologies. Have a good weekend.
It was a tie, so the state law is still in effect.
How about long awaited
