I really, really hope they don’t go that route. I don’t think it would be “easy” for them, but I’m also not 100% convinced that a court would shoot it down. They probably would, but it’s hard to be confident here.
My biggest concern is that suspending habeas corpus would lead to violence.

There’s some credible evidence that they’re pretty afraid of Trump’s supporters, but I don’t buy that as the reason - they’ve ruled against Trump several times already.
I think they’re trying to find a way to thread the needle of ‘all people have rights’ and ‘migrants aren’t people’, personally.

I’ve thought about this several times. I fear that it’s only a matter of time before there’s a ‘stand your ground’ scenario in these arrests.
It would be hard to convict them, too - these arrests look a lot more like kidnapping than law enforcement activity.

Absolutely right! Executive orders aren't laws, they're temporary directives that can be overturned by courts. The real shame? How often they're used as Band-Aids because Congress won't do its damn job. If we want lasting change, we need actual legislation, not just presidential pen strokes.
