The language is absolutely a problem, agreed. It’s unnecessarily formal. I work with legal text all the time, and I would need a lawyer for at least two parts of the license. No need for that.

1.2 was terrible on various grounds, including the idea that the license could be changed whenever WotC wanted. It’s wild seeing the DP license take the same path.

I don’t know. The license was like this since it came out for Candela Obscura, then was updated and it’s all still really restrictive. I would be surprised they don’t know. CR has been moving in a more restrictive direction since their early days.
