A final report will hopefully clarify this question. But in my 28 years of airline experience, controllers normally include the distance and direction of conflicting traffic. “Traffic 9 o’clock and 3 miles.” This solves any confusion a pilot may have as to what traffic is being reported.

That’s correct. The pilot doesn’t actually request visual separation, they just acknowledge to ATC that they have the aircraft in sight. The controller will usually respond with “maintain visual separation from that traffic.” But it’s every pilot’s responsibility to be aware of any situation.

The CRJ was on an instrument approach to runway 1, with a circle to land on runway 33. The CRJ was just turning to left to land on RWY 33 when they collided. The CRJ was 200 feet above the helicopter and descending in this picture. The CRJ was following ATC instructions. For all the good it did them

Neither. From what I heard from the somewhat choppy recording was the Blackhawk acknowledging seeing the CRJ. The normal response from ATC in a situation like that is “Maintain visual separation from that aircraft.” That shifts all the responsibility on to the pilot to avoid that aircraft.

The helicopter pilot was flying under VFR, visual flight rules, and informed ATC he had the CRJ in sight. Separation was now the Blackhawk’s responsibility. The real question is what aircraft did the Blackhawk actually have in sight.
