This is, as above, the best decision. Basically the judge said “yeah nah”. It seems like the most proper pathway/due diligence for a judge to be able to reject the request to dismiss the case (if that is what he will eventually decide).

Tl;dr is that the judge did not dismiss the case as requested by the DoJ, even though he could have. It’s just been taken off the calendar indefinitely while the judge awaits the amicus brief (someone to argue on the other side) from an outside attorney he appointed to assist with this decision.
