SCOTUS didn’t even have equitable discretion to vacate Boasberg’s orders b/c he was in the middle of contempt proceedings. You have to have “clean hands.” It would be like a drug dealer filing a complaint because he didn’t get paid. Cannon did the same thing in the documents special master case.

If a future Democratic trifecta wanted to float a trial balloon on expanding the Supreme Court, they should expand the lower courts to the point that their appointments in red states are the majority. And scrap the convention of giving the senators of a state a say in who gets nominated.
