A call for a stuck elevator came in from DHS at 26 Federal Plaza at 7:37 p.m. It was a ruse. There was no stuck elevator. The fire truck responding opened a space that ICE used to drive a van of kidnapped people through. ICE evaded protesters apparently by calling in a false emergency call.

This seems flatly indistinguishable from having them perform ordinary law-enforcement functions, which is (wait for it) illegal. Absent an invocation of the Insurrection Act, military cannot enforce domestic law against civilians.

California Governor Gavin Newsom has said deploying the National Guard is "purposefully inflammatory and will only escalate tensions." There’s a substantial amount of social science backing up Newsom’s suggestion.

The military is generally barred from domestic law enforcement. Kristi Noem’s request may be a step toward the Trump administration sidestepping those laws by invoking the Insurrection Act.

he and his people are already acting as if they have invoked the insurrection act, is the thing. I think it is a mistake to assume that there will be some big moment when he does so, or that he thinks he needs one. As things stand, he’s way beyond the bounds of the statute he cited.
