6/ As a legal historian of the Civil War Era, this will all be an excellent example to use when I teach the ways that while there have always been questions about the scope of federal power, state's rights rhetoric is almost always opportunistic and disingenuous.

4/ Miller's also suggesting that federal law is always supreme over state's rights and can be used at will of the President, even though POTUS does not have the power to determine law's legitimate use.

3/ The issue here though is that states are not saying the law justifying federal action is unconstitutional (Title 10 U.S Code). They're saying it's being misused in a way that renders the action itself unconstitutional. That distinction matters.

2/ They were written by James Madison and Thomas Jefferson in opposition to the Alien & Sedition Acts, which included none the Alien Enemies Act of 1798. This is the law the Trump administration has invoked to justify arresting, detaining, and deporting immigrants, without solid legal authority.

You are of course correct. I jest to draw attention to the absurdity of the government's claims, and to emphasize what I know to be true of the people of my hometown. They're warm, kind, and generous - in spirit and culinary delights. Perhaps it was the wrong approach.

It would be an absolute trip if the protesting Angelinos started feeding the Marines. Bring the taco trucks, hot dog carts, and the horchata vendors to underscore federal failure. Let the people know what a real avocado is supposed to taste like.

This reminds me of the conversations around the Fugitive Slave Acts (1793 and 1850) and the 1842 SCOTUS ruling in Prigg v. Pennsylvania. Time for CA to pass some "personal liberty laws" that protect public officials/employees who refuse to comply with federal forces.

Yes and it is important to distinguish that those antislavey views evolved for a range of reasons and did not necessarily translate into a belief in Black equality. It’s the evolution in thought that I always find the most remarkable and the most humanizing of an otherwise mythologized man.

As a historian who teaches this particular period, I wonder whether he's aware of the crippling depression that defined the decade... Or whether that's the point.
