Due process requires providing the other side an opportunity to be heard. Briefing is the usual way to do it. Then the judge can rule on a complete record. Finding contempt on a complete record is more likely to be upheld on appeal. Does that make sense?

It’s actually not uncommon for a judge to give a party multiple chances to avoid contempt. It helps on appeal.

Just asked Senator Merkley, my senator, to be the first Senator to call for Schumer to step down. Merkley endorsed Bernie for president in 2016 when no one else would. He can be the first again here. I hope he listens.

Exactly. They are daring the court to find them in contempt. They hope a higher court will save them. But I’m not sure an appeals court or the Supreme Court wants to sanction willful violations of district court orders.

They are all waiting for the first contempt order to fall. Once it does, more will follow. Today’s hearing may not result in contempt, but another hearing as to why a contempt order should not issue. It will happen eventually.

It’s generally not a good idea to have one of your people get on tv proclaiming court orders will be denied shortly before a hearing that could find you in contempt of a court order.

Trump is 0 for 2 in the Supreme Court so far this term. There is certainly the potential for disaster with future rulings, but that would require the court to minimize its power and importance in the face of a wanna-be dictator. I don’t think it’s a done deal that they will approve his nonsense.

The judge’s verbal comments were an interpretation of his own order. It seems the judge believes the order has been violated. Your personal belief doesn’t count. We’ll see what happens at the hearing.
