Scuttlebutt has it that during Jan 6. Trump claimed that he that he instructed that the Mayor of DC, Pelosi and DoD head to be notified that there were 10K military available “to help Capitol Police”…ahead of 1/6.
That violates the Posse Comitatus Act.

Neither of those scenarios are provisions of the Posse Comitatus Act or the Federal Code 10 U.S.C. § 12406 (2023), which both can only be set in motion by Trump UNDER specific parameters of their respective laws. They can be complicated and under strict scrutiny within a chain of command.
