Very interesting! Important to note also the exploitative labor practices that go along with AI content moderation practices which are exported abroad: papers.ssrn.com/sol3/papers....

I was listening on my drive this morning! So many golden nuggets of truth and wisdom! Her latter points on A.I. really resonated with my work, especially this recent piece: www.yalelawjournal.org/forum/ai-and...

With truly great help from you! Although I have to add that it's more of a colloquium and not a full-blown conference yet. Hopefully with more funding, we can make it a conference in the future!

This, too, is a good reason to adopt "A.i."

This isn't restricted to Emory sadly. I encountered this at other doctor offices. In the past, I found that if you push, they will provide you with a clipboard with the paper documents...BUT you still have to sign on the pad. SIGH.

YES! And the restaurant should have little carts that whip about adding to the anticipation, bamboo basket steamers, and brusque yet efficient waiters.

Thanks for posting! We do indeed have a great wealth of AI experts at Emory Law.

Audits take long when the systems are not *designed* to support them. In several papers, I note the issue of ex post vs. ex ante regulations. Ex ante regulations include "fairness by design" features (built in to allow for easy audits for example. See, www.law.georgetown.edu/georgetown-l...

We can try. Pre-clearance audits don't try to keep up at all since it's a one and done. But seriously, the main check/regulation will have to be design based but with the expectation that even the design requirements will be ever-evolving as the tech progresses.

I agree! That's why my paper argues for auditing design features.

Yes, I do argue for both...but my focus is on the auditing that should happen *after* adoption...often times, pre-clearance auditing can serve as an unwarranted shield or carte blanche for the Ai systems to be used in ways that are often distal from how they are marketed and cleared for use.

Tutt's paper was ground-breaking for its time (it was published in 2016) but the paper's proscriptions no longer hold for what we now know about machine-learning algorithms...

I actually argue for something greater than a pre-clearance mechanism. Rather, I argue for *continued* auditing of AI hiring systems to ensure they are not insidiously replicating bias or data-laundering unlawful discrimination.

I show exactly how this happens when you use AI for hiring in this paper:The Paradox of Automation as Anti-bias Intervention: papers.ssrn.com/sol3/Papers....
Which is why I advocate for "An Auditing Imperative for Automated Hiring:" papers.ssrn.com/sol3/papers....
