The point of RBG's landmark de jure sex discrimination cases (like Frontiero, Weinberger, and Boren) is discrimination against men is also discrim. against women through biased assumption norms. Barrett thinks sex discrimination only protects women but it's an ill that strikes in all directions.

I am seriously wondering: In the future, will the Roberts' Court be most often compared to the post-Civil War Plessy court? Or the pre-Civil War Dred Scott court?

Well we do all remember Justice Harlan's dissent in plessy more than who were the majority Justices. But all the pain, death and sadness was not worth that ultimate fame. Same will be said about this opinion but only after damage, pain, and death to kids and their families.

Congratulations! My favorite quote about tenure came from a Prost I worked with: "Tenure is the condition in which you can do what you did yesterday for the rest of your life."

Margery will have a second chance to vote against the "Big Ugly" once the Senate changes anything in the House Bill. But she will still vote for it.

Oh it is coming: June 14th. Trump's big beautiful Soviet-style military parade. His uniform will include a Congressional Medal of Honor. Bank it.

Been thinking about this a lot lately: "When people begin to believe that organized society is unwilling or unable to impose upon criminal offenders the punishment they "deserve," then there are sown the seeds of anarchy--of self-help, vigilante justice, and lynch law." Stewart, J., Furman at 308.

Why are all these Trump appointees now wearing Gordon Gekko hair stylings? or, maybe I know?

This is classic Roberts Court -- No law or legal analysis. Just policy wealth protectionism and dare I add -- vibes?

Ned Ludd understood that attacking the source of worker displacement and oppression (then, the mill machines) would lead to improvements in worker conditions.

Long ago, there was a SNL skit where experts discussed topics sent in by viewers. On was a question by a young boy asking what would have happened at Waterloo if Napolean had a fully outfitted B-52 Bomber (from my sketchy memory).

Or, as Bob Dylan wrote/sang: They say that Patriotism is the last refuge to which a scoundrel clings, Steal a little and they throw you in jail, steal a lot then they make you king. Spot on again, Bob!

These are the kind of petty acts, like Marie A's "let them eat cake," that can lead to a whole string of shocking consequences.

And, decisions made on the basis of political or ideological diversity would clearly violate the First Amendment and Due Process. Depending on the ideology (e.g. Christian Nationalism, white supremacy), maybe we could throw in Equal Protection as well?

That upside down Flying V. "I'll play the blues for you" Saw him twice at old Antone's in Austin. Each amazing, memorable concerts. Not just for the music but also for King's personality (grumpy perfectionist smoking a pipe.)

Your last line is a brilliant truth. The ultimate counterfactual in this place at this time. I guess one day people may wake up from their dream of being a butterfly and they will answer that question.

I agree with you that we muddle the issues by blaming anonymous "institutions" rather than the real co-conspirators and culprits -- Republicans. We can't fix this if our aim is not true.

Loved your piece. Saw Highlander in the theater in 1986 when I lived on South Beach. It had all the cinamatic language of Miami Vice which we sorta lived but in NYC where many came from. We loved it. Plus of course, as Public Defenders, our great oft-quoted line was born in the movie: "I am a worm."

There is a traditionaljapanese art form that involves just what you are doing and then catching the image on absorbant paper. It is said no practitioner/artist can ever fully master the full possibilities of meaning.
