hegseth stated that he "believed" trump and he could do it. trump apparently did not invoke the Insurrection act. He would have to make the claim first. Aside from not being an insurrection as was Jan 6 when the Capitol was attacked, what they have done is not legal and is Executive Overreach.

For an actual "Insurrection" the president can call out National Guard without a state's approval. BUT, I don't think this qualifies as insurrection. The supreme court will probably get this and we'll see how they deal with it. Although I'm dubious of their rulings.

Having pronounced the situation an insurrection is highly suspect. More than likely, calling the National Guard and Marines to respond does not fit the criteria. The fact that people who are complying with the legal process have been aggressively arrested is legally and morally wrong.
