The US is currently about 31st in the developed world, in per-capita support of public media. Trump is going to change that to 33rd.

I think what we need is a new Fairness Doctrine. Shutting down the FCC would be giving things a fresh start, actually. Keep Carr from persecuting news networks. Create a new agency when he's gone.

The more usual argument (e.g. NetChoice v Paxton) is that the FA protects the corporate SM platform from regulation. Chemerinsky has a novel argument, that we can't ban TikTok because of its users' rights.

Yes, banning TikTok is unprincipled and arbitrary. But I think the article illustrates why we shouldn't rely on our Supreme Court's wacky FA jurisprudence to chart the future.
We need principled experts to develop a regulatory scheme for social media. And not be terrified of government action.
