To be sure, the court agreed to stay the nationwide injunction, but didn’t take the extra step of adding the case to its docket so it could resolve a problem that “has evaded this Court’s review,” as Prelogar put it.

This is in fact how fascists have made law throughout US history. They act, violently, they take stuff, they stay there. They make clear that they're not leaving. Everyone backs off, the courts say fine, and then that's the law.
