It was actually an O5 today, but the guy is so clueless AND cocky he might as well be a newly pinned O4. Either way, my biggest headaches in the last nearly 25 years of military/government service have always come at the hands of one of those two ranks.

Folks, if ever you feel any sense of inadequacy, just know that somewhere, deep in the dank, dark SCIFs of the DOD, is an O4 or O5 so utterly and confidently wrong about something that they singlehandedly will fuck things up for everyone else around them.

Yeah, if the state code doesn't explicitly address it, it might be open to interpretation. Or perhaps addressed in some state military command policy/regulation. Again, talking to an SJA from the state in question is the best bet.

Texas code of military justice, for instance, has like an abbreviated version of the UCMJ in the state code, which leaves certain articles open to interpretation where the T10 version is more specific in its elements.

I fought tooth and nail at USARPAC to get the DCE there to work with HIEMA and HING rather than pushing the easy button of going across the hall to FEMA-PAO for everything. Then they had major turnover-the new DCO and deputy had to be taught from scratch. Makes doing real-world response 10x harder.
